Terms of service

1. Your account

You must give a valid email address and keep your sign-in details safe. You are responsible for what happens in your account, including the actions of team members you invite. Tell us right away if you think someone has accessed your account without permission. You must be old enough to form a binding contract where you live.

2. Your data and your visitors

You own the data your websites send to Calmstats. You give us permission to store and process it only to run, secure and improve the Service for you. When Calmstats processes your visitors' data, our Data processing agreement applies and forms part of these terms.

You are responsible for:

• Having the right to install Calmstats on the websites you add.
• Telling your visitors about your use of analytics in your own privacy notice, and getting consent where the law where you or your visitors are requires it.
• Not sending passwords, payment card numbers, government IDs, health data or other sensitive personal information in events, properties, paths or campaign tags.

We may use anonymous, aggregated statistics about how the Service is used (for example total events processed) that do not identify you, your websites or your visitors.

3. Acceptable use

You agree not to:

• Use the Service for anything illegal, or to track people in a way that breaks privacy or consumer laws.
• Install Calmstats on websites you do not own or control, or that host illegal content, malware, phishing or scams.
• Try to identify individual visitors from the data, or combine it with other data to do so.
• Send fake, automated or inflated traffic, or interfere with or overload the Service.
• Probe, scan or test the Service's security without our written permission, or get around usage limits or access controls.
• Copy, resell or rebuild the Service, or scrape it, except through features and APIs we provide for that purpose.

If you break this section we may limit, suspend or close your account, with notice where reasonable.

4. Plans and usage limits

Each plan includes limits on websites, team seats, monthly events, data retention and features, as shown on our pricing page. The Free plan stops recording new events once its monthly limit is reached. Paid plans allow a small buffer above their limit; beyond it we may stop recording new events until the next billing month or until you upgrade. Features marked as beta or preview may change or be removed and are provided as they are.

5. Billing

Paid plans are billed in advance, monthly or yearly, and renew automatically at the end of each period until you cancel. Prices are shown before you pay and may exclude taxes, which are added where required. Payments are handled by our payment processors, which may act as the seller of record for your purchase and whose checkout terms also apply to the payment.

Changing to a different plan starts a new subscription at the new price. We may change our prices; for an existing subscription the new price applies from your next renewal, and we will tell you before it does. Promotional offers and discount codes follow the conditions shown when you redeem them and can't be combined unless we say so.

If a payment fails, we may retry it and, after notice, move the account to the Free plan or suspend paid features until it is paid.

6. Cancellation and refunds

You can cancel any time from Billing in Settings. Your plan stays active until the end of the period you have paid for, and is not renewed after that. Payments already made are not refundable, except where the law requires it.

If you were charged by mistake, or the Service did not work for you in your first 14 days on a paid plan, email us at hello@calmstats.com and we will review a refund. Nothing here limits rights you have under consumer law.

7. Connected services

Some features work by connecting accounts you hold elsewhere, such as payment providers, stores or Google Search Console. Your use of those services is governed by their own terms. You authorise us to read the data needed for the feature you turn on, and you can disconnect at any time. We are not responsible for those services or for changes they make that affect the Service.

8. Availability and changes

We work to keep Calmstats running and publish its status at status.calmstats.com, but we do not promise it will always be available or free of errors. We may improve, change or retire features. If we make a change that substantially reduces a paid feature you rely on, you can cancel and ask for a prorated refund of the unused period.

9. Ending the agreement

You can stop using Calmstats and close your account at any time. We may suspend or close an account that breaks these terms, puts the Service or others at risk, or has been inactive on the Free plan for a long period, with notice where reasonable. After an account is closed we delete its data as described in our Privacy policy. Sections that by their nature should continue, such as liability limits, survive the end of the agreement.

10. Our property

Calmstats, its software, design and brand belong to us. We give you a limited, non-exclusive right to use the Service during your subscription. If you send us feedback or ideas, we may use them without any obligation to you.

11. Disclaimers and liability

Analytics are estimates. Ad blockers, browser settings, bots and network conditions mean numbers will never be exact, and revenue attribution is a model of what led to a sale, not a certainty. The Service is provided "as is" and "as available", without warranties beyond those the law requires.

To the extent the law allows, Calmstats is not liable for indirect, incidental or consequential losses, lost profits, revenue or data, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Some places do not allow these limits, so they may not fully apply to you.

You agree to cover our reasonable costs from claims by third parties that arise from your websites, the data you send, or your breach of these terms.

12. General

We may update these terms. For significant changes we will tell you by email or in the dashboard before they take effect; continuing to use the Service after that means you accept them. If part of these terms can't be enforced, the rest still applies. Not enforcing a term is not a waiver of it. You may not transfer this agreement without our consent; we may transfer it as part of a merger or sale of the business.
